Terms of Use

1. INTRODUCTION AND ACCEPTANCE

These Terms of Service ("Terms") constitute a binding legal agreement between UNSAID ("Company," "we," "us," or "our"),and you ("User" or "you").

By registering an account, purchasing a subscription, or using the UNSAID platform (the "Service"), you explicitly agree to be bound by these Terms.

2. NATURE OF THE SERVICE (NO MEDICAL ADVICE)

2.1. Entertainment and Simulation Only.

You acknowledge that UNSAID is an AI-powered simulation tool designed for entertainment, storytelling, and roleplay purposes only. The "Personas" created by the Service are fictional representations generated by Artificial Intelligence. They are not real people, ghosts, or conscious entities.

2.2. Not a Substitute for Therapy.

The Service is NOT a healthcare provider, medical device, or a substitute for professional psychiatric care, grief counseling, or suicide prevention services.

Waiver: By using the Service, YOU VOLUNTARILY ASSUME ALL RISKS of emotional distress, mental anguish, or psychological harm. You explicitly waive the right to sue the Company for any mental health consequences resulting from the AI's output.

2.3. AI Hallucinations.

You understand that Large Language Models (LLMs) may "hallucinate," generating false, nonsensical, or potentially offensive information that is not present in your uploaded data. The Company is not liable for the accuracy or tone of the AI's output.

3. USER CONTENT AND WARRANTIES

3.1. Ownership.

You retain ownership of the chat logs, text files, and screenshots ("Input Data") you upload.

3.2. User Representations and Warranties.

By uploading Input Data, especially data involving third parties (e.g., ex-partners, friends, relatives), you explicitly represent and warrant that:

• Consent: You have obtained all necessary valid consents from the individuals involved in the chats to upload their data for analysis.
• Legitimate Interest: In the case of deceased individuals, you warrant that you are the legal next-of-kin or have a legitimate right to memorialize the individual.
• No Illegal Content: You will not upload content involving minors, non-consensual sexual content (NCII), or content promoting violence.

3.3. Indemnification.

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE COMPANY from and against any and all claims, damages, liabilities, costs, and expenses (including legal fees) arising from:

• Your violation of third-party privacy rights (e.g., if a third party sues us because you uploaded their private chats).
• Your breach of these Terms.

4. DATA PROCESSING (TECHNICAL LIMITATIONS)

4.1. Immediate Deletion of Raw Data.

We do not store your raw uploaded files (TXT, JSON, Screenshots) on our servers permanently. These files are processed in-memory (RAM) to generate mathematical vector embeddings and are permanently deleted immediately after the analysis process is complete.

4.2. Vector Embeddings.

You grant us a license to store "Vector Embeddings" (mathematical abstractions of conversation styles) in our database solely to enable the "Persona" memory functionality.

5. SUBSCRIPTION AND BILLING

5.1. Subscription Plans.

UNSAID is a subscription-based service. Access to create and interact with Personas requires an active, paid subscription.

5.2. Automatic Renewal.

Your subscription will automatically renew at the end of each billing cycle (e.g., monthly) unless you cancel it at least 24 hours before the renewal date. You authorize us to charge your payment method for the renewal fee.

5.3. Cancellation.

You may cancel your subscription at any time via your Account Settings. If you cancel, your access continues until the end of the current billing period. We do not offer partial refunds.

5.4. NO REFUNDS & EU RIGHT OF WITHDRAWAL WAIVER.

General Policy: Due to the immediate computational costs (GPU usage) incurred by the Company, ALL SALES ARE FINAL.

EU Consumers: If you are a consumer in the EU, you typically have a 14-day right of withdrawal. HOWEVER, by purchasing a subscription and immediately accessing the Service (e.g., creating a Persona, message a chat), YOU EXPRESSLY CONSENT TO THE IMMEDIATE PERFORMANCE OF THE CONTRACT AND ACKNOWLEDGE THAT YOU THEREBY LOSE YOUR RIGHT OF WITHDRAWAL.

6. PROHIBITED CONDUCT

You strictly agree NOT to:

• Use the Service to generate "Deepfakes" for fraud, harassment, or defamation.
• Generate sexually explicit content involving real individuals without their consent.
• Attempt to reverse-engineer the AI or scrape data from the platform.

7. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

8. GOVERNING LAW

These Terms are governed by the laws of Poland. Any disputes shall be subject to the exclusive jurisdiction of the courts located in Poland.
